본 연구는 언론 보도에서 SNS 콘텐츠를 인용하는 관행이 확산되는 가운데, 해당 관행이 자율규제와 법적 규제체계에서 어떻게 평가되고 있는지를 분석하는 것을 목적으로 한다. 이를 위해 언론사와 자율규제 기구의 규범 문서를 검토하고, 한국신문윤리위원회와 인터넷신문윤리위원회의 심의사례, SNS 인용 보도로 인한 법적 분쟁 판례를 분석하였다. 분석 결과, 자율규제 차원에서는 SNS 인용 보도가 선정 보도, 출처 표기 미흡, 편집지침 위반 등의 문제를 중심으로 반복적으로 심의되고 있었으며, 법적 판단에서는 SNS 게시물의 사실성 여부, 추가취재의 존재, 보도의 공익성 등이 핵심 판단 기준으로 작동하고 있었다. 본 연구는 SNS 인용 보도를 자율규제와 법적 규제가 교차하는 지점에서 분석함으로써, 향후 가이드라인 정비와 법적 판단 기준 논의에 참고 가능한 분석 틀을 제공하고자 한다.

This study aims to analyze how the practice of citing SNS content in news reporting is evaluated within systems of self-regulation and legal regulation, amid the increasing prevalence of such practices in journalism. To this end, the study reviews normative documents of news organizations and self-regulatory bodies, and analyzes deliberation cases from the Korea Press Ethics Commission and the Internet Press Ethics Commission, as well as court rulings related to legal disputes arising from SNS citation in news reporting. The analysis reveals that, at the level of self-regulation, SNS citation practices have been repeatedly deliberated mainly with respect to issues such as premature reporting, inadequate source attribution, and violations of editorial guidelines, while in legal judgments, key criteria have included the factual accuracy of SNS posts, the presence of additional journalistic verification, and the public interest of the reporting. By analyzing SNS citation in news reporting at the intersection of self-regulation and legal regulation, this study aims to provide an analytical framework that can serve as a reference for future discussions on guideline revision and legal judgment standards.
