This thesis critically examines the doctrine of humanitarian intervention and the Responsibility to Protect (R2P), exploring their normative foundations, practical applications, and political implications in the contemporary international system. Through a comparative case study analysis of Kosovo, Iraq, Libya, Syria, and Palestine, it assesses the extent to which these frameworks effectively protect vulnerable populations without compromising state sovereignty or being co-opted for strategic interests. Drawing on international legal instruments, institutional records, and academic literature, the study interrogates the ethical, legal, and geopolitical dilemmas that arise when states or coalitions intervene in humanitarian crises. The research demonstrates that while R2P offers a powerful normative vision grounded in the protection of human rights, its implementation remains hindered by institutional paralysis, selective enforcement, and contested legitimacy. Particular emphasis is placed on the structural asymmetries revealed in the Palestinian context, which highlights the persistent role of power politics in shaping international responses. The thesis argues for the urgent development of non-military alternatives—including preventive diplomacy, legal accountability, and capacity-building—to offer more sustainable and impartial protection mechanisms. Ultimately, this study contributes to ongoing scholarly and policy debates by proposing a more ethically grounded and operationally coherent framework for humanitarian action, one that reconciles the imperative to protect with the realities of global governance and political constraint.

본 논문은 인도적 개입(humanitarian intervention)과 ‘보호책임(R2P, Responsibility to Protect)’ 원칙을 비판적으로 고찰하며, 이들의 규범적 기반, 실제 적용 방식, 그리고 오늘날 국제 질서 내 정치적 함의를 다각적으로 분석한다. 코소보, 이라크, 리비아, 시리아, 팔레스타인 사례에 대한 비교 연구를 통해, 이 두 틀이 취약한 민간인을 효과적으로 보호하면서도 국가 주권을 훼손하지 않고 전략적 이해에 악용되지 않을 수 있는지를 평가한다. 국제법 문서, 제도적 기록, 학술 문헌을 바탕으로, 본 연구는 국가 또는 연합이 인도적 위기 상황에 개입할 때 발생하는 윤리적, 법적, 지정학적 딜레마를 심층적으로 분석한다. 연구 결과, R2P는 인권 보호에 기반한 강력한 규범적 비전을 제시하고 있으나, 제도적 마비, 선택적 적용, 정당성 논란 등으로 인해 실행 면에서는 한계가 존재함을 보여준다. 특히 팔레스타인 사례는 구조적 불균형과 권력 정치의 지속적인 영향력을 드러내며, 국제사회 대응의 현실적 제약을 부각시킨다. 본 논문은 예방 외교, 법적 책임 추궁, 역량 강화 등 비군사적 대안의 시급한 개발을 통해 보다 지속 가능하고 공정한 보호 체계를 마련할 필요성을 강조한다. 궁극적으로 본 연구는 보호의 당위성과 세계 거버넌스의 현실 사이의 간극을 좁히고자, 보다 윤리적이고 실행 가능한 인도주의 개입의 틀을 제안함으로써 학문적 논의와 정책 설계 모두에 기여하고자 한다.
