이 논문은 무력충돌의 주된 피해자인 여성을 보다 적극적이며 효율적으로 보호해야 함을 지적하며, 이와 관련하여 국제기구와 국제인도법의 역할을 강조한다. 그리고 전쟁시 국제인도법의 맥락에서 여성을 독립적인 개인으로 보호하는 체제가 갖는 단점을 검토한다. 제2차 세계대전 이후 우크라이나와 아프가니스탄과 같은 현대전에 이르기까지 수많은 여성들은 여전히 피해자의 입장에 처해 있었지만 국제법은 이 문제에 대해 적절한 구제방안을 제시하지 못한 것 같다. 국제기구가 관련 조약을 제정하거나 권고를 채택하여 여성을 보호하려는 노력을 기울이고 있는 것은 사실이지만, 이러한 노력은 충분하지 않으며 이 문제에 더 많은 시간과 노력을 투자해야 할 것으로 보인다 이 중요한 목표를 달성하기 위해 국제 기구, 더 많은 국가, 정부 및 조직의 협력과 지원이 필요하다. 이 논문의 제1장의 초점은 연구의 범위와 방법론이다. 2장에서는 전쟁이 여성에 미치는 영향에 초점을 맞추고 있으며, 전쟁과 그들의 삶을 황폐화시킨 폭력의 영향을 받은 여성, 그리고 젠더 기반 폭력, 강제 추방과 같은 관심을 받지 못하거나 간과된 전쟁의 영향에 대해 간략히 설명한다. 세 번째 장은 우리가 여성에게 적용되는 국제인도법의 발전과 관련 내용에 초점을 맞춘다. 검토결과 이 논문은 국제인도법이 특정 유형의 남성의 경험을 규범으로 간주하기 때문에 차별적 제도라고 판단하였다. 설령 관련된 규칙과 규정이 있지만 제대로 시행되지 않는다는 점에 유의해야 한다. 제4장에서는 국제 형법과 여성 보호에 대해 논의 한다. 논의를 명확히 하기 위해 당시에 특히 중요했으며 오늘날에도 유사한 사례에 대한 지침 및 연구 사례로 사용되고 있는 ICTY 및 ICTR을 참조하였다. 제5장은 여성과 전쟁에 관한 UN 개발에 초점을 맞추었다. 여기서는 여성과 무력 충돌에 관한 UN 활동에 대한 짧은 역사와 소개로 시작하였으며, 유엔이 창설된 후 25년 이상 동안 여성의 무력충돌이라는 주제가 다루어지지 않았다는 점을 강조하였다. 이는 여성에게 영향을 미치는 특정 문제가 없거나 여성이 우선 순위가 아니거나 문제를 처리하는 것이 다른 사람의 의무라는 것과 같은 여러가지 편견을 찾아볼 수 있다.이 모든 요소는 비상 사태 및 무력 충돌 상황에서 여성과 아동에 대한 CSW의 초기 작업에서 볼 수 있었다. 마지막으로 6장에서는 주제의 의미에 대한 추가 제안으로 논문을 마무리하였다.

초록/요약

This thesis addresses the importance of examining the protection of women in relation to armed conflict and emphasizes the role of international organizations and international humanitarian law in this regard. And its purpose is to examine the shortcomings of protecting women in the context of international humanitarian law in times of war as an independent individual (not as a role they play in society or culture, such as motherhood, protection, and care for patients elderly, etc. the fact is that to date there have been many experiences of women in conflicts from the time of the world wars to modern wars such as Ukraine or Afghanistan, but international law has not been able to pay much attention to this issue. It is true that international organizations have tried to protect women by drafting treaties or adopting relevant recommendations, but history shows that these efforts are not enough and sufficient. We should therefore need a shift of approach to this issue. We should note that these efforts are not possible only with the cooperation and assistance of international organizations, and more countries, governments, and organizations must work together to achieve this important goal. The summary and main contents of each chapter are as follows. Chapter 1 is on the scope and methodology. Chapter 2 focuses on the effect of warfare on women which we briefly talk about women affected by wars and violence which devastated their lives and the impact of warfare which is overlooked or not given the attention it deserves like gender-based violence, enforced displacement and etc. Chapter 3 focuses on the IHL which we described the development and present substance of ILH that applies to women. This thesis found out that IHL is a discrimination regime because it considers mainly the experiences of certain types of males as a norm. of course, it should be noted that there are rules and regulations but there are not enforced properly. Chapter 4 discusses international criminal law and the protection of women. To better understand this chapter and clarify the discussion we refer to the ICTY and ICTR which were of special importance in their time and are still used and referred to today as a guideline and study case for similar cases. Chapter 5 focuses on the efforts taken by the UM concerning women and armed conflict. With a short history and introduction about the UM Works regarding women and armed conflict. And we emphasized that the subject of women in armed conflict was not addressed in the UM system for more than twenty-five years after its founding. This may be caused by prejudice, for example, according that there are no specific concerns about women’s suffering, that are, they are not a priority, or that dealing with the issue is someone else’s duty. All of these elements may be seen in the CSW’s early work on women and children in emergency and armed conflict circumstances. Chapter 6 is a general conclusion with further propositions on this topic
