As the knowledge-based industry grows, Intellectual Property Rights is becoming an important issue not only in an international environment but also in each individual country. With this trend, countries have started to protect their IPRs by joining international treaties including TRIPS agreement and by establishing FTAs that contain protection of IPRs. Along with international economic trends, South Korea has established FTAs with many countries, one of which being the South Korea and China FTA. As of August 2014, China is South Korea’s largest trade partner. Since South Korea’s dependence on exports to China is becoming increasingly more important, the South Korea and China FTA is expected to bring the biggest economic effects. However, there are gaps in IPRs protection between South Korea and China. To maximize economic effects and reduce damages related to IPRs protection in the South Korea and China FTA, South Korea should consider China’s IPRs conditions and develop a tailored way to deal with IPRs issues and negotiate firmly during the Korea-China FTA negotiations. This paper will analyze the main expected issues on IPRs protection between two countries and draw implications for the South Korea and China FTA based on a comparative study on IPRs regime of two countries.
