Figuring out the relationship between trade and the environment regarding sustainable development has been one of the most important and difficult issues of the World Trade Organization (WTO). In particular, since the fundamental value of the WTO has been the trade issue rather than the non-trade issue, WTO has struggled to make well-internalized policies on environmental issues by having environmental provisions and establishing the Committee on Trade and Environment. Also, by providing dispute resolution on the environment-value involved dispute case that automatically taken as rule to comply for all member states, WTO has been trying ensure that international institutions regard the environment as an important issue. Although the WTO has made a great effort to embrace the emerging non-trade values for sustainable development, the achievement from the effort has led to criticism of its effectiveness. In this paper, by examining existing environmental policies in the WTO and the case study of the Shrimp-Turtle case with an understanding of political dynamics at international and domestic level of the WTO member countries, analysis of the systematic and normative perception of the WTO on environment issue will be provided through the Constructivist approach. Based on the analysis, this paper will demonstrate the requirements for the WTO to be handle the environment issue more effectively.
