E-commerce is spreading widely through the internet, and has led to the legislation of special provisions in countries around the world. The WTO which deals with trade within e-commerce announced a tariff ban on electronic transmissions, during a Cabinet Meeting in May 1998 and in September of the same year a work program on e-commerce was prepared triggering fundamental discussions. Through reductions in transaction costs and heightening of management transparency and productivity, the importance of e-commerce is becoming more and more in direct connection with national competitiveness and secure growth of national corporations. In Korea, aspects like tax, payment methods, intellectual property, case law and jurisdiction, consumer protection, privacy protection and settlement of disputes are yet to be covered by supplementary provisions. Until now, the motive of the rapid growth in e-commerce came from its non-regulative characteristics, a value that falls in line with the WTO’s objective. Therefore, it is vital that future regulations do not harm the development of e-commerce. International standards must be legislated at a general level, and specific contents must be left to the free settlement forces of the market.
